2007年新疆维吾尔自治区知识产权保护状况
一年来，在自治区党委和自治区人民政府的领导下，自治区的知识产权保护工作，坚持以邓小平理论和“三个代表”重要思想为指导，以强化实施自治区知识产权战略推进工程为主线，深入贯彻科学发展观，知识产权保护能力和保护水平有新的提升。
一、党委、人大、政府和政协更加重视知识产权工作
自治区党委、政府更加重视知识产权工作。3月21～22日，自治区人民政府在乌鲁木齐昆仑宾馆召开了“自治区知识产权试点示范工作会议”。自治区主席助理靳诺主持会议，自治区党委常委、自治区常务副主席陈雷、国家知识产权局副局长邢胜才、自治区人大副主任张国梁等领导出席会议。陈雷副主席作重要讲话，他从坚持科学发展观和建设创新型国家重大战略的高度，深刻分析了当前自治区经济社会发展面临的机遇与挑战，精辟阐述了全面做好知识产权工作的重要性、紧迫性，对自治区知识产权工作提出了新要求；4月17日，在乌鲁木齐召开了《2007年新疆维吾尔自治区保护知识产权宣传周新闻发布会》，自治区副主席胡伟到会讲话。会议发布了“2006年新疆维吾尔自治区知识产权保护状况”和自治区2006年知识产权典型案例，对自治区第一批9家商业专利保护试点单位进行了授牌，启动了自治区商业企业专利保护试点工作；7月31日，自治区人民政府办公厅印发了《关于成立自治区知识产权战略制定工作领导小组的通知》，成立了由自治区党委副书记、常务副主席杨刚为组长，自治区主席助理靳诺等领导为副组长、自治区党委宣传部等33个部门和单位参加的自治区知识产权战略制定工作领导小组；10月10日，自治区工商局组织召开了“美克·美家、库尔勒香梨荣获中国驰名商标揭牌仪式暨企业商标战略高层论坛”。自治区党委副书记、常务副主席杨刚，自治区副主席胡伟等领导出席会议并作重要讲话；10月24日，在乌鲁木齐举行了“国家知识产权局中国专利局乌鲁木齐专利代办处开业揭牌仪式”，自治区主席助理靳诺出席仪式并讲话。
自治区人大、政协关注知识产权保护工作。为使《专利法》和《自治区专利保护条例》列入自治区人大2008年“一法一条”检查工作之中，10月，自治区人大教科文卫工作委员会和知识产权局组成调研组，对乌鲁木齐、昌吉、奎屯、伊犁、巴州、石河子、克拉玛依等地区3年来贯彻执行《自治区专利保护条例》情况进行了实地调研；4月25日，自治区政协邀请自治区知识产权局局长姜万林向民主党派、工商联负责人及在乌鲁木齐的政协委员通报当前新疆知识产权保护形势、存在的问题及采取的对策等情况。
各部门积极加强知识产权保护工作。自治区科技管理部门在科技项目管理、科技兴县市等项工作中把专利申请作为一项重要考核验收指标；自治区知识产权局会同经贸委和科技厅，以试点示范为抓手，积极推进企事业单位知识产权试点示范工作；自治区知识产权工作协调指导小组等组织，充分发挥协调指导作用，大力推进知识产权保护工作；1月23日，自治区人民检察院、自治区整规办等召集20个部门召开会议，就知识产权行政执法与刑事司法衔接工作进行了座谈和研讨，制订信息共享、情况通报、联席会议制度，落实自治区《关于在行政执法中及时移送涉嫌犯罪案件的意见》要求，强化案件移送工作，加强行政执法与刑事司法的联系和配合，努力营造良好创新发展环境；自治区保护知识产权工作组成员单位在保护知识产权专项行动中，以“政府统筹、协调高效、适应区情、保护有力”为指针，以查处假冒、冒充、侵犯他人知识产权等违法行为为重点，开展多领域、全方位咨询服务举报投诉活动，依法打击各种违法侵权行为；自治区整规办、保知办在知识产权宣传周期间，协调专利、商标、公安等部门开展联合执法活动。自治区保护知识产权举报投诉报务中心积极加强自身建设，安装了电子网络传输系统，通过全国反商业欺诈网实现了案件办理网上对接；制订下发了《关于建立自治区保护知识产权举报投诉服务机制的意见》（暂行）；有3人获得了全国颁发的上岗证书，提升了工作效率和案件接收、批转、办理的质量和能力。
二、保护知识产权专项行动深入开展
自治区认真贯彻落实国务院《保护知识产权行动纲要（2006～2007年）》精神，按照国务院保知办和国家知识产权局的统一部署和要求，坚持宣传教育与严厉打击相结合、行政执法与刑事司法相衔接、部门互动与上下联动相协调，扎实推进知识产权保护工作。据统计，2007年，在专项行动中全区共出动执法人员10.1万人（次）,出动执法车辆6000多车（次），检查各类场所近8000个,检查商品10.65万件，查处各类侵犯知识产权案件3400件，案值3133.9万元，取缔、处罚非法经营单位、摊点3.7万个（家），处罚金778.9万元,收缴非法出版物1732971册（张），没收侵权货物5.9万个(件)；自治区知识产权举办投诉服务中心开展公众咨询1856人次，受理举报投诉案件7件，审查批转4件，结案3件，举报投诉案件转交率达到60%，举报投诉办案率达到75%。
三、努力营造良好的保护知识产权环境
（一）知识产权保护体系进一步完善
知识产权保护体系建设又有新的进展。2007年，自治区克孜勒苏柯尔克孜自治州成立知识产权工作协调指导机构，阿图什市等4市一县以及霍城县清水河经济开发区挂牌成立知识产权管理机构。自治区林业厅所属科研、勘察设计和教学单位均设立了保护植物新品种工作管理机构，配备了专兼职工作人员。截至2007年年底，全区14个地州市建立专利、商标、版权等知识产权管理、协调机构；有55个县(市、区)和2个国家级开发区挂牌成立知识产权局；全区专利管理人员达到225人，专利执法人员251人；全区有专利代理机构5个，具有专利代理资格证的人员49人，从事专利代理业务的人员22人;全区商标代理机构43个；自治区林业系统知识产权管理机构有5个，专兼职工作人员17人，具有资质证书的林业专业执法、司法鉴定人员28名。
（二）知识产权宣传成绩斐然
2007年4月，全区以纪念第七个“4·26世界知识产权日”为契机，组织开展丰富多彩的保护知识产权宣传周活动。4月24日，自治区整规办和知识产权局在昌吉市联合举办了“新疆第三届‘知识产权杯’知识竞赛”活动；自治区保知办及其成员单位在乌鲁木齐国际机场等显要位置，设立3块大型户外广告宣传牌；在乌鲁木齐市280家办公楼、写字楼和宾馆以大屏幕多媒体形式，每天60次播放保护知识产权专题宣传片；在各边境口岸悬挂了中文和外文（英、俄、哈、蒙等）宣传横幅、张贴了宣传画；深入各商场开展宣传咨询打假活动，张贴发放专利、商标、版权知识、12312宣传画、报刊夹页和手提袋等宣传品。据不完全统计，在宣传周活动中，全区共出动工作人员1900多人（次），出动宣传车辆720台（次），制作大型户外宣传牌3块，印发12312报刊夹页、保护知识产权手提袋等宣传资料40多万份，现场咨询3.5万人（次），发布宣传口号6420多条，举办座谈会、报告会、讲座、知识竞赛59场（次），出宣传板报2900块，悬挂横幅2620多条。
（三）知识产权教育培训成效显著
2007年，自治区积极实施知识产权万人培训计划，大力加强对管理、执法、司法和科技等人员的专业知识和法律知识培训。据不完全统计，全年全区共举办各类知识产权培训班、专题报告会302期（次），参加人数62412人（次），其中举办知识产权培训班199期，培训人数20873人（次）；举办专题报告会103次，参加人数41575人（次）。
随着知识产权宣传培训工作的深入和公民知识产权保护意识的增强，自治区的知识产权数量和质量明显提升。2007年自治区专利申请2270件，同比增长0.6%，其中，发明专利申请476件，同比增长24.9%，实用新型专利申请1255件，同比增长7.6%；职务发明专利申请764件，同比增长29.7%，其中大专院校专利申请48件，同比增长52.6%，科研院所专利申请315件，同比增长56.9%，工矿企业专利申请476件，同比增长20.2%；2007年，全区专利授权1534件，同比增长29.2%；职务发明专利授权477件，同比增长50.5%，其中大专院校专利授权23件，同比增长43.8%，科研院所专利授权149件，同比增长52.0%，工矿企业专利授权299件，同比增长48.8%，机关团体专利授权6件，同比增长200.0%；非职务发明专利授权1057件，同比增长21.5%。截至2007年年底，全区专利申请量累计达到19801件，专利授权累计达到11103件。自治区专利申请、授权和累计量均在西北五省区排第二位。2007年，自治区注册商标申请量比去年增长10%以上；新获驰名商标1件，累计5件；著名商标累计151件；地理标志数量已超过20件，在全国排第三位。2007年自治区已登记各类作品310件，同比增长100%。2007年自治区林木品种权申请22件，累计58件；授权1件、累计5件。
四、知识产权行政、司法保护不断开拓创新
（一）扎实有效开展专利行政保护
2007年，自治区专利管理部门制定并实施《自治区加强知识产权保护工作方案（2006～2007年）》，在全区组织开展了保护知识产权专项行动。为加强商业领域知识产权保护，自治区制定了《商业企业知识产权（专利）保护试点工作方案》，在4月17日启动商业领域识产权保护试点工作。各级专利管理部门在执法活动中，坚持平时与重大节日、纪念日及会展期间开展专项执法相结合；专利执法与公安、工商、整规办等部门联合执法相结合；自治区与各地专利管理部门执法相结合。各地各部门整合执法资源，密切协同、上下互动，形成合力，努力营造保护知识产权的社会环境。据统计，2007年，全区共出动专利执法人员599人（次），检查营业场所340个，检查标有专利标记的商品13593件，受理专利纠纷案件44件，结案27件，查处冒充专利行为案件48件，受理并审结自治区知识产权举报投诉服务中心移交案件1起，参加法院行政诉讼案件3起。由于专利执法工作突出，2007年，自治区知识产权局法律事务处被评为全国专利执法先进集体,受到国家知识产权局的表彰奖励。
（二）深入开展商标行政保护
2007年，自治区商标管理部门认真落实自治区工商行政管理工作会议精神，坚持“一手抓执法、一手抓服务”，积极查处商标侵权假冒案件，依法保护商标专用权，面向基层积极开展服务工作，大力普及商标法律知识，支持企业创造自主知识产权，培育著名和驰名商标，取得了显著成效。（1）突出重点，严厉打击危害人身健康的食品、药品以及侵犯著名、驰名商标和涉农、涉外商标专用权的商标违法行为。截至2007年年底，全区共查处商标违法案件1045件，其中一般商标违法案件147起，商标侵权假冒案件898起，罚款286.8万元，案值1496.62万元，收缴和消除违法商标标识201.35万件，没收、销毁侵权商品51.84吨。（2）加强了与国内外著名、驰名商标企业及其品牌代理商、知识产权代理机构联系与协作，完善了商标保护网络，提高了商标执法效能。（3）以“3·15消费者权益保护日”、“4·26世界知识产权日”和商标节为契机，积极开展保护知识产权宣传活动，增强社会公众商标保护意识。（4）以企业荣获中国驰名商标和新疆著名商标为契机，努力营造保护商标、争创著名和驰名商标的氛围。（5）积极实施自治区商标战略，提升企业品牌价值和市场竞争力，带动和促进自治区经济社会又好又快发展。2007年，自治区工商管理部门在完成第四届新疆著名商标认定的基础上，组织开展了第五届新疆著名商标认定工作，对100家企业的104件著名商标申请材料进行了受理审查。经申报并经过国家商标局认定，“美克·美家”牌家具成为我区第5件驰名商标。与此同时，自治区工商管理部门加大了对“新农”牌棉花等一批具有较高知名度商标的企业创立驰名商标的培育和指导。
（三）进一步拓展版权行政保护
2007年,自治区版权管理部门积极拓宽保护范围，将版权保护拓展到娱乐、服务等众多行业和传统工艺等新的领域，使版权管理工作逐步规范，版权保护环境明显改善，版权执法成效显著。
2007年，自治区版权管理部门在巩固政府软件正版化工作成果的同时，将软件正版化工作拓展到勘察设计企业、网吧和大型企业。一是自治区版权局会同建设厅印发了《关于在全区勘察设计行业开展软件正版化工作的通知》，制定了实施方案，对乌鲁木齐地区的16家勘察设计单位使用CAD软件情况进行了检查，选择5家作为示范单位予以挂牌表彰；对伊犁、石河子、博州和昌吉州的15家设计企业使用CAD软件情况进行检查，下发了勘察设计行业CAD软件正版化工作的通报，提出了完成操作系统和办公配套软件正版化的要求；与教育厅和浩辰软件公司向新疆大学建工学院开展了CAD软件捐赠活动。捐赠CAD软件达450套、价值145万元。二是自治区版权局会同文化厅印发了《关于在全区网吧行业开展软件正版化工作的通知》，对全区网吧组织开展了检查活动，对未授权的软件要求限期删除，更换正版软件。三是筹备并启动了大型企业软件正版化工作。对自治区软件正版化领导小组成员进行了调整；制定了自治区大型企业软件正版化实施方案；在新疆广汇、八一钢铁、新疆电力等12家大型企业开展软件正版化工作。
2007年，自治区版权管理部门认真贯彻落实国家版权局、公安部和信息产业部《关于开展2007年打击网络盗版专项行动的通知》精神，紧密结合实际，制定了自治区2007年打击网络侵权盗版专项行动方案，会同通信管理局对新疆网通的天脉网、新疆电信的丝路宽频网站进行了检查。对传播电影、音乐、软件、动漫作品网站的现状进行了普遍摸底调查，有效地开展了打击“三无网站”和未经许可传播音乐、电影、软件网站的专项行动。据统计，2007年全区共检查经营单位12853家，取缔非法经营单位143家，行政处罚439起，移送司法机关侵权案件12起，查获地下窝点一个，罚款2万元，查缴各类侵权盗版制品834125件，其中盗版图164565册，盗版音像制品616083盘（张），盗版软件17232张，盗版电子出版读物10217张，其他盗版作品2431件。
2007年，自治区版权管理部门加大了对工艺品市场的宣传执法检查力度。在各市场张贴了《关于禁止销售侵权工艺美术品的通告》，进行广泛的宣传。在商贸城、国际大巴扎、国贸城、二道桥市场及米泉市进行执法检查活动，捣毁复制侵犯版权作品的窝点，有效遏制了各旅游品市场销售侵权制品的势头。另外，自治区版权管理部门积极开展版权贸易审查，全年审批出版外国图书合同16件。
自治区信息产业厅把计算机软件保护作为振兴软件产业、加强行业管理的一项重要工作常抓不懈，在做好组织领导、规范管理、协调服务等工作的同时，积极开展计算机软件产品认定、计算机软件著作权登记、软件正版化推进等工作，取得了较好的成效，截至2007年年底，全区已有通过认定的软件企业53家，计算机信息系统集成资质企业258家，通过认定的自主研发的软件产品155个，计算机软件著作权登记16个。
（四）积极推进植物新品种行政保护
2007年，自治区林业管理部门以林木种子、种苗及植物新品种保护为重点，对14个地州市86个县（市）2700余个林业苗圃进行了2次专项检查活动，有效遏制了侵犯品种权和假冒品种案件的发案率，防止了木材种类假冒和木材产品商标侵权行为的发生。据统计，全年全区共出动执法人员222人（次），执法车辆101车（次），抽查苗木2579万株,涉及苗木数量达382万株。另外，自治区林业厅还加大了对流通领域的知识产权保护力度，组织相关部门对全区4800余个木材市场和木材加工企业进行了检查。
2007年，自治区林业厅根据《新疆维吾尔自治区野生植物保护条例》，首次发布了新疆重点保护野生植物名录。有109种野生植物纳入第一批保护范围，其中一部分属于濒危、特有或珍惜的野生物种。
2007年，自治区被农业部列为全国农业植物新品种保护执法试点省区之一。在试点工作中，自治区农业厅在全区范围内开展了农业植物新品种保护科技执法大检查，有效地遏止了侵犯品种权和假冒授权品种案件的发生。自治区农业管理部门广泛开展宣传培训工作，大力普及品种权保护知识，积极组织品种权申请工作，新品种保护事业得到了较快发展。
（五）进一步加强知识产权海关保护
在知识产权海关保护工作中，乌鲁木齐海关加强领导，统筹部署，从维护和改善我国和平发展环境的高度出发，不断加强对假冒侵权进出口商品的查处力度并取得较好成绩。2007年海关共查获侵权案件35起，同比增长12.9%，案值达124.5万元。自治区企业和个人在海关总署的知识产权备案为14项。
2007年，乌鲁木齐海关积极加强与工商、版权、公安等部门的合作，不断建立完善与政府部门、企业和权利人及下属部门之间的工作合作、联动机制，形成上下联动、齐抓共管的工作格局。在办案活动中，乌鲁木齐海关将权限下放，深入基层，开展调查研究,加强对基层业务的指导、服务和监督。各隶属海关都有知识产权办案部门，建立了联络员队伍，制订了完善的知识产权管理制度。在风险管理、查验等环节设置知识产权保护岗位，配备了相关的人员，为知识产权保护提供了组织、人员、机制保障。在处理案件中，执法人员通过采取简化程序同步操作的方法，缩短办案时间，提高办案速度，减少费用支出，维护了权利人的合法权益。
2007年，乌鲁木齐海关组织开展了知识产权保护“龙舟行动”。为使专项保护行动更有成效，针对点多面广、监管对象分散多样等特点，乌鲁木齐海关对20多个企业进行了摸底检查，建立了侵权企业“黑名单”和侵权商品资料库。在货运现场，针对混装、夹藏、伪报瞒报、分离标识、使用近似商标和类似商标等隐蔽的重点侵权行为，明确告知并补充申报。在邮递现场，注意审核物品品名和品牌、分析收寄件人信息和物品寄递的流向，加强对“化整为零”式邮递物品的查验。在旅客检查现场，针对过往旅客国籍和身份证、运输工具始发地和目的地以及物品等情况确定查缉重点，并取得阶段性成果。截至2007年年底，海关在保护知识产权“龙舟行动”中，共查获侵权案件22起，查获手机、手机电池、运动鞋、运动裤、旅行包、墨粉、光碟等16种侵权商品，涉及诺及亚、摩托罗拉、松下、阿迪达斯、佳能等17个国际著名商标，侵权物品件数达45453件，有力打击了口岸侵权势头。
（六）卓有成效地开展知识产权刑事司法保护
自治区公安机关积极开展知识产权刑事保护工作。2007年，自治区公安厅成立了由公安厅副厅长王乐祥同志为组长的“打击侵犯知识产权犯罪工作领导小组”，建立了对重特大案件实行公安厅挂牌督办制度，加强了对知识产权刑事保护工作的统一指挥和协调。从4月1日起，自治区公安机关在全疆开展了为期6个月的打击侵犯知识产权“山鹰二号”专项行动，查处了一批侵犯、冒充知识产权的案件。
在知识产权刑事执法活动中，自治区公安机关积极加强与烟草、卫生、农业、质监、工商、知识产权等行政监管部门和执法部门的沟通联系，相互协作，建立健全联合执法、密切配合的长期协作机制，充分发挥各职能部门的作用，形成打击合力。公安机关高度重视流通领域的知识产权保护工作，坚持对流通领域中的假种子、假化肥、假农资等伪劣商品案件的打击力度，积极维护知识产权权益人和消费者的利益。据统计，2007年，各级公安机关受理侵犯知识产权案件12起，破案11起，案值1141.9万元，挽回经济损失57.5万元；查获与知识产权有关案件47起，破案31起，涉案金额946.94万元，挽回经济损失313万元；抓获犯罪嫌疑人50名；收缴盗版非法音像制品32316盒，非法出版物品12000张，非法书刊450000余本，非法宣传品5910张。
2007年，自治区各级人民法院，积极开展知识产权司法保护工作。全年全区法院共受理知识产权案件251件，其中一审案件219件，二审案件32件；在审理的案件中，专利侵权案件36件，商标侵权案件98件，著作权侵权案件74件，植物新品种侵权案件1件，技术合同纠纷案件28件，其他知识产权纠纷案件2件；审结知识产权纠纷案件237件，其中一审结案200件，二审结案37件；在审结的案件中，审结专利纠纷案件30件，商标纠纷案件75件，著作权纠纷案件63件，植物新品种纠纷案件1件，技术合同纠纷案件29件(含上年遗留案件)，其他知识产权纠纷案件2件；知识产权纠纷案值2138.4万元。
五、对外交流活动有新进展
2007年5月30日，自治区工商管理部门在乌鲁木齐举办了“与外商投资企业定期沟通协调机制第16次交流会”，日本贸易振兴机构会员单位以及大韩贸易振兴公社外商投资企业等60余家企业代表参加；9月10日，在乌鲁木齐召开了“飞利浦知识产权保护研讨会”，飞利浦（中国）投资有限公司等外资企业代表及中华商标协会中国企业商标发展中心、自治区商标管理干部70多人参加；12月20日，在乌鲁木齐召开了“中日商标协作保护研讨会”，奥林巴斯、建伍、索尼、丰田、三菱、凯迩必（ＫＹＢ）、本田、卡西欧、日立等日本知名商标企业，中华商标协会中国企业商标发展中心、日本贸易振兴机构北京代表及自治区商标管理干部200多人参加。8月23日～9月6日，自治区知识产权局组织地州市知识产权局局长共9人到澳大利亚和新西兰考察培训。

1. Party Committee, People’s Congress, Government and Political Consultative Conference pay more attentionto intellectual property
The Party Committee and Government of the Autonomous Region pay more attention to intellectual property. March 21~22, the “Intellectual Property Protection Trial Demonstration Meeting of Xinjiang Uygur Autonomous Region” was held by People’s Government of Autonomous Region in Kunlun Hotel in Urumqi City. Jin Nuo, the assistant of Chairman of Autonomous Region held the meeting, Chen Lei, the standing committee member of CPC committee of Xinjiang Uygur Autonomous Region, the standing vice-chairman of Xinjiang Uygur Autonomous Region, .Xing Shengcai, the deputy director of State Intellectual Property Bureau, . Zhang Guoliang, the deputy director of People’s Congress of Xinjiang Uygur Autonomous Region, and other leaderships, attended the meeting. The vice-chairman, . Chen Lei, gave the important speech, from the height of construction innovation new type country magnitude strategy and insisting scientific development view, deeply analyzed current the Autonomous Region economy society development faced chance and challenge, pointed elaborated the important and urgency impendence of getting done with the intellectual property in its entirety, put forward new requirement to the intellectual property in Autonomous Region. On April 17, Hu Wei, the vice-chairman of Autonomous Region, gave speech at the “2007 News Release Conference in Propaganda Week of Intellectual Property Protection in Xinjiang Uygur Autonomous Region” in Urumqi, the Conference released the “Report on Intellectual Property Rights Protection in Xinjiang Uygur Autonomous Region in 2006” and typical cases of intellectual property in Autonomous Region in 2006, conferred brands to the first batch 9 commerce patent protection trial units in Autonomous Region, started the commercial enterprise patent protection trial working. In 2007, the public security authorities of autonomous region established the “Leading Group of Striking the Criminal Infringement” with the leader of Wang Lexiang, the vice direction of public security authorities, created the supervision system of carrying on public security authorities with its shingle hang out to the gross case or extraordinarily serious case, strengthen the unified command and cooperative to the intellectual property criminal protection work. Since the date of April 1, the autonomous region public security authorities carried on the special action “Mountain Eagle No.2” of combating against infringement on intellectual property lasted for 6 months, investigated and prosecuted a batch of cases of intellectual property infringement or counterfeit.
During the operation of intellectual property criminal law execution, the autonomous region public security authorities actively strengthened the cooperation and communication with the Administrative Supervision Department including tobacco, sanitation, quality supervision, industrial and commercial, intellectual property etc. and law execution department, to establish and health the long-term cooperative mechanism of joint law execution and close cooperation, fully bring each functional department into play, to form the join forces combat. The public security authorities pays great attention to the intellectual property protection work in circulating field, insists the combat force to the cases of imitative and inferior commodities including pseudo-sperm, inferior fertilizer and inferior agricultural means of production etc. in the circulating field, actively protect the intellectual property equity owner and customer. According to statistics, in 2007, each stage of public security authorities accepted 12 cases of intellectual property infringement, solved 11 cases, with the total value involved in the cases of CNY 11.419 million, retrieved the economic loss of CNY 0.575 million; ferreted out 47 cases concerning intellectual property, solved 31 cases involving a money amount of CNY 9.4694 million, retrieved the economic loss of CNY 3.13 million; arrested 50 criminal suspects, captured 32316 boxes of pirated illegal audiovisual products, 12000 pieces of illegal publications, over 450000 pieces of illegal books and periodicals, and 5910 piece of illegal propaganda materials.
In 2007, each stage of People’s Court in Autonomous Region actively carried on the work of intellectual property judicial protection. All the year round, the court accepted 251 cases of intellectual property right including 219 cases of first instance, 32 cases of second instance; among the legal cases there were 36 cases of patent infringement, 98 cases of trademark infringement, 74 cases of copyright infringement, 1 cases of infringement of new plant species, 28 controversy over a technology contract, 2 cases of other intellectual property rights disputes; all together there were 237 cases of intellectual property disputes were closed with verdicts after trial, 200 cases were closed with verdicts at first instance, 37 cases were closed with verdicts at second instance; among the closed cases, 30 patent controversy were closed with verdicts, 75 trademark controversy were closed with verdicts, 63 copyright controversy were closed with verdicts, 1 controversy over infringement of new plant species were closed with verdicts, 29 controversy over the technology contract were closed with verdicts (include the left over cases of last year), 2 cases of other intellectual property rights disputes were closed with verdicts; the total value involved in the intellectual property rights disputation cases was CNY 21.384 million.
5. New Progress on Foreign Intercommunion Activity
On May 30, 2007, Autonomous Region Industrial and Commercial Administrative Department held “The 16th Intercommunion Conference about Periodical Contact and Coordination with Foreign-invested Enterprise”, there were more than 60 enterprises including JETRO (Japan External Trade Organization) Member and KOTRA (Korea Trade-Investment Promotion Agency) Foreign-invested Enterprise attended the conference; on September 10, there were 70 people including foreign-funded enterprises representatives from Philips (China) Investment Co. Ltd and cadres from China Trademark Association China Enterprise Trademark Development Center and Autonomous Region Trademark Administration attended the “Philips Intellectual Property Protection Conference” held in Urumqi City; on December 20, there were more than 200 people including the representatives from Japanese enterprises with well-known trademark such as Olympus, Kenwood, Sony, Toyota, Mitsubishi, KYB, Honda, Casio and Hitachi etc. attended the “China-Japan Trademark Cooperative Protection Conference” held in Urumqi City. From August 23 to September 6, there were 9 people including the directors from Intellectual Property Department of local, prefecture and city went to Australia and New Zealand for investigation and training which was organized by Autonomous Region Intellectual Property Bureau.
