In an effort to protect Olympic symbols, ensure the legitimate rights and interest of their holders and regulate use of them, the State Administration for Industry and Commerce(SAIC) promulgated the Measures for the Registration and Administration of Olympic Symbols on April 22, 2002. The Measures became effective on June 1, 2002.
According to the Measures, the right owners may file it directly to the Trademark Office under SAIC or entrust it to the authorized agencies of trademark. Where the right owners do not have residence or business address in China, they shall entrust it to the authorized agencies of trademark. A Licensing agreement of Olympic symbol shall include the following contents: Olympic symbol and its recordation number; products licensed to use the symbol and its scope of service; geographical scope; duration of use. The right owner of the Olympic symbol shall submit a copy of the licensing contract to the Trademark Office under SAIC for recordation within one month after the conclusion of the agreement.
